GamesYap respects the work of creators, and we expect everyone who publishes on GamesYap to do the same. This policy explains how to tell us about material you believe infringes your copyright and what happens next. It follows the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (DMCA) and similar laws in other countries.
How to report
The fastest way is our copyright form. You can also email support@gamesyap.com with “Copyright notice” in the subject line.
What your notice must include
- Your full name, postal address, telephone number and email address.
- A description of the copyrighted work you believe has been infringed.
- The exact address (URL) of each game or page on GamesYap that contains the material, for example
https://gamesyap.com/game/example-game. - A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act on the owner’s behalf.
- Your physical or electronic signature (typing your full name is enough).
Incomplete notices take longer, because we have to ask for the missing details first.
What happens next
When we receive a complete notice, we review it and, where appropriate, remove the material or disable access to it, usually within a few working days. We tell the developer who published it and share a copy of the notice with them (we may remove your personal contact details first).
Counter-notice
If your material was removed and you believe this was a mistake, or that you have the right to use it, you can send a counter-notice to the same address. It must include:
- Your full name, address, telephone number and email address.
- The material that was removed and the address where it appeared.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- A statement that you consent to the jurisdiction of the courts for your address (or, if you live outside the United States, any judicial district where GamesYap may be found) and that you will accept service of process from the person who sent the original notice.
- Your physical or electronic signature.
We forward valid counter-notices to the person who sent the original notice. If they don’t tell us within 10 to 14 working days that they have filed a court action, we may restore the material.
Repeat infringers
We close the developer accounts of, and remove all games from, anyone who repeatedly infringes the rights of others. Players who repeatedly use infringing names or images on their profiles may lose their accounts too.
False claims
Knowingly sending a false notice or counter-notice can make you liable for damages. If you aren’t sure whether something infringes your rights, consider getting legal advice first.
Other concerns
For trademark issues, impersonation or other content concerns, use the same form and explain the issue. For problems with how a game works, use Report a problem on the game’s page.
